Terms and Conditions

These Terms and Conditions ("Agreement") govern the use of the services provided by made43.com ("Service Provider") to its clients ("Clients"). By accessing or using the services offered by made43.com, Clients agree to be bound by this Agreement.


1. Services Provided


1.1 Content Creation: made43.com offers content creation services to Clients, which may include but are not limited to articles, blog posts, social media content, website copy, and other written materials.


1.2 Monthly Subscription: Clients subscribe to a monthly subscription plan for access to the content creation services provided by made43.com. The subscription can be canceled at any time without any additional fees or penalties.


1.3 Royalty-Free Rights: Clients will have royalty-free rights to all content created by made43.com during the subscription period. Clients may use, modify, and distribute the content as they see fit, without any additional compensation or attribution to made43.com.


1.4 Subscription Pause: Clients have the option to pause their monthly subscription. During the pause, the subscription will be temporarily inactive, and no subscription fees will be charged. Clients may request a subscription pause via the account dashboard or by contacting made43.com's customer support.


1.5 Calculation of Remaining Time: When a subscription is paused, the remaining time left in the current billing cycle will be calculated by subtracting the number of days already used in the month from 31 days. This calculation is used to determine the duration of the billing period upon re-activation.


1.6 Resuming the Subscription: Clients can request to resume their subscription after the pause period by contacting made43.com's customer support. Upon resuming the subscription, the billing will continue after the remaining days calculated during the pause have passed. The regular subscription fees will be charged for the subsequent billing cycles. These amended clauses are incorporated into the existing Terms and Conditions.


2. Responsibilities and Obligations


2.1 Client Responsibility: Clients assume full responsibility for the use, distribution, and legality of the content created by made43.com. Clients must comply with all applicable laws and regulations regarding the use of the content.


2.2 Contractor Relationship: made43.com acts as a contractor and not an employee of the Client. The Client does not have the right to control or direct the methods and procedures used by made43.com to provide the services.


2.3 No Guarantees: While made43.com will make reasonable efforts to deliver high-quality content, no guarantees are made regarding the results or outcomes of the content creation services. The success or effectiveness of the content is dependent on various factors beyond the control of made43.com.


2.4 Content Queue: Content requests from Clients are completed according to the order of the Queue. Clients can place unlimited tasks in the Queue, specifying their content requirements for each task.


2.5 Sequential Completion: While there is no limit to the number of tasks that can be placed in the Queue, only one task will be actively completed at a time. made43.com will work on each task sequentially, starting with the task at the top of the Queue.


2.6 Task Priority: The order in which tasks are completed is determined by their position in the Queue. Tasks placed earlier in the Queue will be given priority over those placed later.


2.7 Task Completion Time: The time taken to complete each task will depend on various factors, including the complexity of the content requested and the current workload. made43.com will make reasonable efforts to complete tasks in a timely manner, usually 48 business hours, but no specific turnaround time is guaranteed. Turnaround is dependent on the task.

Clients acknowledge and accept that the completion of content requests is subject to the order in the Queue and the availability of resources. These additional clauses are incorporated into the existing Terms and Conditions.


3. Payment and Billing


3.1 Subscription Fees: Clients will be charged a monthly subscription fee based on the selected plan. The fee will be clearly communicated at the time of subscription and may be subject to change with prior notice.


3.2 Payment Method: Clients must provide valid payment information and authorize made43.com to charge the subscription fee using the provided payment method. Clients are responsible for keeping their payment information up to date.


3.3 Refunds: Subscription fees are non-refundable, even if the Client cancels the subscription before the end of the billing period. No refunds or credits will be issued for unused portions of the subscription.


3.4 Payment Processing: Payments for the monthly subscription fees are processed by Stripe, a third-party payment processor. Clients authorize made43.com to share necessary payment information with Stripe for the purpose of processing payments.


3.5 Quarterly and Annual Plans: In addition to the monthly subscription plans, made43.com offers quarterly and annual subscription plans. The fees for these plans will be clearly communicated at the time of subscription and may be subject to change with prior notice.


3.6 Renewal and Billing: For quarterly and annual subscription plans, the subscription will automatically renew for the same duration (quarterly or annually) unless the Client cancels the subscription before the renewal date. The applicable subscription fee will be charged in advance for each renewal period.


4. Intellectual Property


4.1 Ownership: All intellectual property rights, including copyrights, in the content created by made43.com belong to the Client once payment has been made in full.


4.2 Client Content: Clients must ensure that they own or have the necessary rights to any materials or information provided to made43.com for the purpose of content creation. Clients grant made43.com a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute such materials for the purpose of providing the services.


5. Termination


5.1 Client Termination: Clients have the right to cancel their subscriptions at any time. The cancellation will take effect at the end of the current billing period, and no further charges will be incurred.


5.2 Service Provider Termination: made43.com reserves the right to terminate or suspend the services provided to a Client at any time for violation of this Agreement or any other valid reasons. In such cases, any remaining balance of the subscription fee will be refunded to the Client on a pro-rata basis.


5.3 Refunds for Quarterly and Annual Plans: For quarterly and annual subscription plans, if the Client cancels the subscription before the end of the current billing period, a refund will be issued for the unused portion of the subscription fee on a pro-rata basis.


6. Limitation of Liability


6.1 Indirect Damages: In no event shall made43.com be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to this Agreement or the use of its services, even if advised of the possibility of such damages.


6.2 Maximum Liability: The total liability of made43.com for any

direct damages arising out of or relating to this Agreement or the use of its services shall be limited to the total subscription fees paid by the Client for the three months preceding the incident giving rise to the claim.


7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which made43.com operates. Any disputes arising out of or in connection with this Agreement shall be resolved by the courts of that jurisdiction.


8. Modifications to the Agreement


made43.com reserves the right to modify or update this Agreement at any time without prior notice. Clients are encouraged to review the Agreement periodically for any changes. Continued use of the services after any modifications constitute acceptance of the updated Agreement.


By using the services provided by made43.com, Clients acknowledge that they have read, understood, and agreed to be bound by these Terms and Conditions.
